Nationally legal psychoactive products seem too good to be true. However, the Farm Bill`s 2018 hemp designation and THC guidelines make Delta-9 legal nationwide. However, some hemp growers, such as The Hemp Doctor, have been able to use the 0.3% delta-9 THC restriction to their advantage. As long as they can ensure that their hemp products meet this proportional requirement, they are able to offer products containing significant amounts of delta-9 THC to a domestic audience. One is an illegal drug found in marijuana, while the other is marketed as a safe herbal alternative. But the alleged differences between them are not supported by science, a group of UConn researchers reported Nov. 1 in Drug and Alcohol Addiction. Vermont operates under the Farm Bill, making delta-9 hemp products legal in the state. At the same time, Vermont has a rule prohibiting «the use of synthetic cannabinoids in the manufacture of hemp products or hemp products.» Currently, the state only applies these rules to delta-8-THC, but theoretically, they can argue that the law also applies to hemp-based delta-9 manufactured products. Hemp-derived delta-9-THC is legal in Louisiana. Therefore, eligible residents can freely purchase hemp-based delta-9-THC products. Thanks to the 2018 Farm Bill, products containing less than 0.3% delta-9 by weight are legal in most states. The exceptions are Idaho with an explicit ban and states like Oregon that have redefined the legal limit for hemp to less than 0.5 milligrams per product.

Consumers should always check the latest local laws before purchasing delta-9 hemp products. Hemp-derived delta-9-THC is legal in Montana. Residents can purchase delta-9 THC compliant products in the state. However, Montana`s Controlled Substances Act prohibits other isomers of THC, including delta-8 and delta-19. Despite legal challenges, hemp-derived delta-9-THC is legal in Arizona. As a result, Arizonans can legally purchase Delta-9 cartridges and extracts in the state. Delta 9 hemp is legal in Hawaii, but some products are not. Hawaii recently banned hemp and cannabinoid smokable gums and beverages. This means that consumers can only purchase hemp-derived delta-9 in the form of tablets, capsules, powder, capsules, capsules or liquid delta-9 syrup. Nevada follows the THC limit of 0.3% under the Farm Bill. However, Nevada has changed the definition of THC to include the sum of all isomers such as delta-7, delta-8 and delta-10. North Dakota`s amended rules also prohibit the conversion of chemical cannabinoids. The law states that hemp licensees «may not engage in the isomerization of cannabinoids to produce tetrahydrocannabinol isomers, including delta-8, delta-9 and delta-10-tetrahydrocannabinol; and the sale of hemp or hemp products made using cannabinoid isomerization to produce tetrahydrocannabinol isomers, including delta-8, delta-9 and delta-10-tetrahydrocannabinol. Hemp-derived delta-9-THC is now legal in Arizona. However, Arizona`s Bill 1715, passed in the state Senate in March, seeks to criminalize the production and sale of «cannabinoids made from hemp.» So now we`re waiting to see if the Arizona House of Representatives passes the bill. The differences in legality between the different versions of THC cause conflicts between the hemp and cannabis industries.
