Which Modern Legal Concept Originated in Ancient Rome

Thus, Roman law fell out of favor with the authorities long before the Reformation. However, the great legal writers in Britain, such as Ranulf de Glanvill (1130-1190), Chief Justiciar of England, and Henry de Bracton (c.1210-1268), a member of the clergy and royal judge, were steeped in the principles of Roman law and not only influenced successive legal authors, but were often cited before the courts, thus indirectly shaping judicial law in England. In his famous treatise De legibus et consuetudinibus Angliae (On the Laws and Customs of England), Bracton included, directly or indirectly, many passages from the Digest, Institutes, and Code of Justinian that have had significant influence and relevance in Western Europe since the eleventh century.17 Professor Osborough noted that such aspects of Roman law, which today remain hidden in common law doctrine, have their place in many cases of the Bracton inheritance.18 In the Republic, the emphasis was more on the adaptation of existing laws by magistrates (ius honorarium) than on the creation of entirely new laws. This occurred especially in the annual Praetorian Edict (codified from 131 AD). Chr.), when the types of admissible, defence and objections cases have been described and an evaluation of the previous year`s legal policy has been carried out, with all necessary legal amendments made accordingly. In this way, it was the application of laws that could be adapted while the law itself remained unchanged, and so a series of case formulas accumulated to provide greater legal cover for the ever-changing situation of Roman society. For example, a fine could be increased to keep pace with inflation, but the legal principle of a fine for a specific offence remained unchanged. This allowed other officials, such as governors and military courts, to «interpret» the law and apply it on a case-by-case basis based on individual circumstances. There are several reasons why Roman law was preferred in the Middle Ages. Roman law regulated the legal protection of property and the equality of legal subjects and their wills, and provided for the possibility for legal subjects to dispose of their property by will.

As for England, it did not adopt Roman law like the rest of the European countries. Roman rules never had the force of law in the country, although they were taught at the universities of Oxford and Cambridge. However, certain substantive rules, concepts and modes of reasoning, which were based on the Roman legal tradition, strongly influenced the English legal system with regard to it. This is because Roman law also offers specificity and power: it has the ability to reduce a problem to one or two sentences and develop a rule. This makes it very similar to Anglo-Saxon law, on which the English legal system is based. Unlike the legal system of continental Europe, the Anglo-Saxon legal system, also known as the common law system, is based on judicial decision-making power, which gives previous judicial decisions the authority of a precedent. The fundamental principle here is that it is unfair to treat similar situations differently on different occasions. The development of Roman law spans more than a thousand years of jurisprudence, which developed in different phases.

A highlight of Roman jurisprudence was the Corpus Juris Civilis (529-34 AD), which was written under the direct direction of Emperor Justinian I (c. 482-565 AD). The Corpus Juris Civilis is a remarkable legacy of a remarkable period in legal history. The constitution of the Roman Republic, or mos maiorum («custom of the ancestors»), was an unwritten set of directives and principles transmitted mainly by precedents. The terms that have their origins in the Roman constitution live on in the constitutions to this day. Examples include separation of powers, separation of powers, vetoes, obstructions, quorum requirements, term limits, impeachments, scholarship powers, and regular elections. Even some less common modern constitutional concepts, such as block voting in the U.S. Electoral College, stem from ideas found in the Roman Constitution. The Norman conquest eventually brought a system of law and order to Britain. William the Conqueror`s victory at the Battle of Hastings in 1066 led to systematic administration. William was ably assisted by Lanfranc, the lawyer who had studied and taught Roman law at Pavia in his native Italy and is sometimes called the prime minister of William the Conqueror.

Lanfranc had previously taught in a school in Normandy. Lanfranc became Archbishop of Canterbury in 1070. Pollock and Maitland, the well-known historians of English law, noted the importance of Lanfranc and continued: Imperial court officials took over the task of prosecuting the criminal accused. A network of spies and investigators passed evidence on to imperial prosecutors. Torture has become a common method of gathering evidence and obtaining confessions. The concept of a fair trial continued to suffer because the emperor could always dictate the verdict. Ancient Rome contributed significantly to the legal systems that still exist in many countries today. The basis of Roman law was the Twelve Tablets, which contained the established body of laws.

Some laws contained in the Twelve Tablets include the obligation to appear in court if asked, the death penalty for lying in court, and the prohibition on holding business or political meetings at night. This system of Roman law has been in force for more than 1,500 years. Emperor Justinian was responsible for creating the Code of Justinian, a compilation of Roman laws that form the basis of civil law in many modern countries. The German legal theorist Rudolf von Jhering noted that ancient Rome conquered the world three times: the first by its armies, the second by its religion, the third by its laws.
