Treaties in Public International Law Notes

Treaties play an important role as a source of international law and stand on a colossal pedestal in this area. 4. International Legal Materials (ILM) (Melb University staff and students only). This series is available on HEIN Online (vol 1, 1962+) in the Law Journal Library collection and in JSTOR (vol 1, 1962+). It is not a series of treaties – but it contains treaty texts and useful introductory information on treaties, and it is an accepted quotation. Note that JSTOR`s holdings are newer than HEIN. The maxim «pacta sunt servanda» binds all signatories to their treaties and is contained in article 26 of the Convention. Therefore, all signatories to the Vienna Convention in the broad sense are bound by any other treaty to which they become signatories. It is interesting to note that the United States has not ratified the Convention. This is probably due to the differences between the legislative and executive branches. Contracts may be classified according to their subject-matter, their object or the number of contracting parties.

These may be political treaties defining a party`s allies or disarmament policy, administrative treaties aimed at defining and defining the functions of international organizations, such as the World Health Organization. Trade treaties on trade agreements such as the GATT, criminal treaties, human rights treaties, treaties that even codify international law and civil treaties are some of the classifications based on the subject. Obligations under international law derive from the consent of the state. For this reason, contracts are generally non-binding and expressly allow a party to withdraw. For example, the Single Convention on Narcotic Drugs stipulates that the treaty will terminate if the total number of signatories falls below 40. There are different consequences for different types of contracts. If the contract is bilateral and one of the parties has caused a material breach of contract, the other party can use it to terminate the contract. If the agreement is multilateral, the default of either Party shall entitle the other Parties to terminate or suspend this Agreement, in whole or in part, with unanimous consent. A material breach, as expressly mentioned in § 61, consists of the breach of a provision of the contract that is essential to it and the abandonment of the contract. A country that has not signed the treaty is not obliged to follow its standards.

However, as the ICJ noted in the North Continental Shelf cases, some treaties may give rise to international conduct and customs and have a «fundamentally normative character». Article 26 of the Vienna Convention on the Law of Treaties deals with the Latin maxim «pacta sunt servanda», that each signatory must comply with the treaty in good faith and bind it. This forms the basis of any international agreement. The following resources cover treaties and arrangements that existed during the League of Nations period. The League of Nations was dissolved in 1946 and replaced by the United Nations. In addition to the journals listed in the Library of Congress online catalogue below, the United Nations has made treaties concluded by the League of Nations available online. The Consolidated Treaty Series is a comprehensive compendium of treaties of all nations concluded between 1648 and 1919. It is also known as Parry`s Treaty Series and has been reproduced online as Oxford Historical Treaties (UniMelb staff and students) and is also available in print at Level 4 of the Law Library.

Multilateral treaties are published in sets such as the United Nations Treaty Series (UNTS). Only treaties deposited with the UN Secretary-General are part of the UNTS. Although most multilateral treaties (and many bilateral treaties) are, of course, deposited with the United Nations, states are not explicitly required to do so. A good source of information on the role of the United Nations as depositary of treaties is the summary of the Secretary-General`s practice as depositary of multilateral treaties on the United Nations website. Treaties with a larger number of participating States acquire international importance because they reflect the importance of the Treaty. However, there are also many important bilateral treaties, such as those that emerged from the strategic arms limitation talks. All contracts have different objectives. Some international organizations have established international organizations through the 1945 Charter of the United Nations, while others deal with issues such as visa requirements. It should be noted that not all contracts can be withdrawn; It depends on the provisions of the Treaty.

For example, when North Korea declared its intention to withdraw from the International Covenant on Civil and Political Rights, the UN Secretary-General concluded that the parties had a reason why the treaty did not provide a ground for withdrawal and that it was not intentionally included. North Korea was not allowed to withdraw. The United Nations International Law Commission drafted the Vienna Convention on the Law of Treaties, which was adopted on 23 May 1969.
