While legal teams are smart people, it`s only natural that they can`t have all the answers. You need quick access to accurate, high-quality data and expertise to facilitate the delivery of legal matters. Making this knowledge accessible as needed is an essential part of materials management. These are projects, so they must be managed with the same care and attention. From scope, budgeting and resource procurement to task allocation, risk tracking and status reporting, issues must be carefully managed, like any other project, to ensure delivery is on time and within budget. While many legal issues are complex and have their own nuances, most legal issues are quite formulated. In other words, they follow a defined sequence of phases and phases that depend on the facts and circumstances of the case. Business management is a term that is regularly used in the legal industry. This is what lawyers and legal operations professionals want to optimize, and this is the challenge that legal technology providers are trying to solve. However, the scope is so broad that it`s easy to get lost on what «matter management» is. To counter the uncertainties, we thought we`d share our thoughts on this topic and explain what we think matter management means and how technology can play a role. As the name suggests, business management is the process of managing a legal case (with or without technology).
But what does this mean? The simplest way to explain this is to first examine the constituent elements of a legal question. «A Legal Matter» is a song written by Pete Townshend and recorded by British rock band The Who for their debut album My Generation. It was recorded at IBC Studios on October 12, 1965 and was released both as the B-side of «The Kids Are Alright» in the United States and as the A-side of a single that reached #32 in the UNITED Kingdom. Both singles were released by Shel Talmy without permission from The Who[1][2] and were the result of a legal dispute between Talmy and the band at the time and an attempt to sabotage the release of the single chosen by the band «Substitute». [3] Optimizing case management has become a priority for many legal teams in recent years, and they are turning to technology to support this initiative. This is part of a rapid trend towards digital transformation in legal services driven by a number of different factors, including but not limited to: Currently, there is no shortage of one-time software solutions that help manage and streamline various components of a legal case. However, the use of separate technological tools presents its own challenges – for example, integration difficulties, data silos, and inefficiencies caused by changing inter-context contexts. Legal departments are also under pressure from their company`s IT teams to simplify and reduce the technology stack.
For these reasons, there is a growing trend away from point solutions for materials management and towards single platforms to optimize the entire material lifecycle in a central system. As a result, legal departments have increasingly adopted comprehensive cloud platforms such as BusyLamp`s Matter.Space in recent years. Atkins also notes the song`s «ironic humor.» [3] Mason also finds the song «funny.» [5] Segretto points out that Townshend`s lyrics are surprisingly misogynistic, but this is tempered by the «playful tone and cute lines like `I just want to keep doing all the dirty little things I do.`» [4] According to Townshend, the song is about «a guy running away from a chick who wants to nail him for breach of contract. What that song was shouting behind lines like «It`s a legal matter, baby, getting married isn`t fun / It`s a legal question, baby, you put me on the run» was: «I`m alone, I`m hungry, the bed needs to be made.» I wanted a maid, I guess. [2] Marsh suggests that the protagonist really doesn`t want to get married because «he`s afraid to find out who he really is (boring, bourgeois, and conventional).» [2] Business management involves only the effective coordination, organization and delivery of all these essential components for legal matters. When people think of the management of matter, they usually think about it at the level of matter (micro level), for example by managing a single matter. This is usually the case for participants in certain issues who need transparency on the substantive activity and who have access to documents and know-how related to the facts. However, the legal departments are constantly dealing with a large number of ongoing issues that also need to be managed and monitored at the portfolio level (macro level). This is especially true for General Counsel, CLOs and those responsible for legal operations who need transparency, reporting and information on all legal matters. Therefore, it is important to remember that material management also includes the management of material portfolios. In order to properly handle a legal case or a portfolio of issues, it is necessary to have access to all the information on the relevant issues. Whether it is information on status, risks, resources, expenses, contracts, issues, etc., this information must be collected, available and easily reportable.
Not surprisingly, Digital Issue Management (DMM) involves the use of technology to support the management and delivery of legal issues. There are many software tools that help improve the discrete elements of a legal issue listed above, from contract assembly and document management systems to expense management and enterprise collaboration applications. While this is a basic approach, even using tools like MS Excel and Dropbox is a form of digital case management that works for many legal teams. Tracking expenses against budget is a key element in any case where outside legal counsel or other legal service provider is engaged. It is always important to monitor how expenses compare to the budget, track work in progress (WIP) and provisions, and look for issues that could negatively impact the budget and expenditures. Law is a team sport. Each legal case involves a wide range of different stakeholders – both within the legal department and the entire company and outside the organisation. Effective property management requires transparent communication and collaboration between all parties involved. Think of lawyers and you will often conjure up images of huge contracts and files filled to the brim with documents. Each legal issue involves documenting a specific description, from contracts and licenses to emails and letters. All this documentation must be stored and managed centrally and securely.
Although business management has received more attention with the growth of legal instruments aimed at streamlining the process, it is important to note that business management is a discipline that has been around for much longer than any software tool. All of these factors lead many legal departments to seriously consider adopting business management platforms to reduce this pressure and increase the value they bring to their businesses. Several commentators have noted an influence of the Rolling Stones on this song, especially on their song «The Last Time». [1] [3] [5] [6] For example, Segretto says that «A Legal Matter» has «a nagging and burgeoning riff that could share DNA with `The Last Time.`» [4] Mason explains that the song «conclusively proves that Pete Townshend worked at a different level than almost any other songwriter in London in 1965.» [5]. Atkins describes the two-note guitar figure used in the song`s introduction as «memorable and catchy.» [3] He explains that the song contains a «short and jerky rhythm», similar to that of their more famous song «My Generation».
