In addition, anything you make available to us through our Services or make available to the public must not contain anything that we deem objectionable (for example, illegal, obscene, hateful, or harmful to you, our customers, or us). We may remove any content at any time. b) We may receive personal data from buyers in order to provide services on your behalf, as described in these Terms and Conditions. We agree to process the Buyer`s Personal Data collected, processed, stored or transferred by us under these Terms and Conditions and other applicable Terms of Use set out above only on your behalf and for the purpose of providing the Services in these Terms and other applicable terms linked above depending on the products you use. We acknowledge that we are prohibited from: (i) selling the buyer`s personal information; (ii) retain, use or disclose the Buyer`s personal data for purposes other than the provision of the services referred to in these Terms and Conditions and other applicable terms of use set out above. As part of and for the purpose of facilitating the Services, Square may (i) anonymize or aggregate Buyer`s Personal Information; and (ii) process Buyer`s personal data for operational purposes, including, but not limited to, verifying or maintaining the quality and security of the Services; improve, update or improve the Services, whether for you or for our customers generally; to detect and prevent fraud and protect the security and integrity of our Services; and compliance with our legal obligations. You acknowledge and agree that the buyer`s personal information that you disclose to Square will be provided to Square for the parties` business purposes. These Terms of Service («General Terms») are a legal agreement between you, as a current or potential customer of Square`s services («you», «your») and Square, Inc. Square Capital, LLC and/or Cash App Investing LLC («Square», «we», «us» or «our») and govern your use of Square`s services, including mobile applications, websites, software, hardware and other products and services (collectively, the «Services»). If you are using the Services on behalf of a business, you represent to us that you have the authority to bind that company or entity to these Terms and that the company accepts these terms. By using the Services, you agree to these Terms and Conditions and all policies («Policies») referenced therein, including our Privacy Policy (see Section 8) and terms that limit our liability (see Section 18) and require individual arbitration for a potential dispute (see Section 21), collectively incorporated herein by reference.

You also agree to any additional terms specific to the Services you use («Additional Terms»), such as those listed below, that form part of your agreement with us (collectively, the «Terms»). You should read all of our terms carefully. You and Square agree to arbitrate all disputes through a neutral arbitrator who has the authority to award the same individual damages and remedies as a court. ANY ARBITRATION UNDER THESE TERMS AND CONDITIONS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS; CLASS ARBITRATION, CLASS ACTIONS, REPRESENTATIVE ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED. YOU WAIVE ANY RIGHT TO HAVE YOUR CASE DECIDED BY A JURY, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST SQUARE. If any provision of this arbitration agreement is found to be unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced (but in no event will there be a class or representative arbitration). All disputes shall be finally and exclusively resolved by binding individual arbitration with a single arbitrator (the «Arbitrator») administered by the American Arbitration Association (www.adr.org) in accordance with this Section and the arbitration rules applicable to this Forum. The arbitrator will be responsible for ruling on all threshold arbitrability issues, including questions relating to whether the Terms and Conditions and/or Additional Terms (or any aspect thereof) are enforceable, unscrupulous or illusory, and for any defense of arbitration, including waiver, delay, fraud or estoppel. Subject to applicable jurisdictional requirements, you may choose to bring your claim in your local small claims court and not arbitration, as long as your case remains in small claims court and is litigated solely on an individual basis (not class by class or non-representative). The Federal Arbitration Act, 9 U.S.C. §§ 1-16, applies without limitation.

If you are a consumer making a claim in connection with a transaction for personal, household or family use, any arbitration hearing will be held in your country of residence. Otherwise, the arbitration will take place in San Francisco, California, or any other mutually acceptable location. The arbitrator`s award shall be binding on the parties and may be entered as judgment in any court of competent jurisdiction. While an arbitrator may grant relief or injunctive relief, he or she may do so only with respect to the individual party seeking relief and only to the extent necessary to provide remedies warranted by the individual party`s claim. An arbitrator`s decision and judgment on this matter has no precedent or collateral effect. Square will reimburse arbitration fees owed to the American Arbitration Association for individual arbitrations commenced under this Section for all claims under $10,000, unless the arbitrator determines that your claims were frivolous. If you win a claim for which you are legally entitled to attorneys` fees, you may attempt to recover those fees from the arbitrator. For claims for which you seek relief, we will not attempt to charge you our attorneys` fees, even if fees would otherwise be awarded, unless the arbitrator determines that your claim was frivolous.
