For reference, here is an example of a legal retention policy from the American Board of Pediatrics. While managing a legal suspension can be simple, many organizations juggle hundreds of legal holds at once, which can be much more challenging. It`s even more complex when these admins change teams or leave the organization. Legal departments can work with HR to track custodian migration, and also work with IT to consider new or retired systems or applications that may impact fleet logistics. To better understand all the steps and lifecycle of a legal suspension, see the diagram below (click image for a larger view): When properly implemented in your legal retention process, CrashPlan enables the ongoing collection and retention of custody account data while ensuring there is no friction between teams and reducing risk to the business. Having a reliable and defensible legal restraint process in place can save you hours of frustration and put you on the right track, not only for the initial issues, but for anything that may arise in the future. A legal retention period is usually initiated by written notice from the legal department to custodians and data processors who may have relevant information about the dispute. The notice directs these trustees to retain – not destroy or alter – all information that may be necessary for discovery, including electronically stored information (ISI) such as emails and spreadsheets, as well as paper records, notes, logbooks and other tangible items. Retention also requires custodians to suspend routine recordkeeping practices, such as automatic deletion of emails or records management schedules. Your legal withholding process is not complete if it does not contain provisions to release the holdback when the withholding obligation has expired.

A legal hold notice allows your organization to resume its normal retention policies and schedules, and allows administrators (internal and external vendors) to resume their usual workflows without fear of looting. Too often, the collection and retention of end-user data for legal retention purposes is done manually by physically seizing devices and storage media. This process leads to headaches, missed or segmented data, and lost productivity. All this before considering the physical access issues caused by remote and hybrid work. CrashPlan has granular roles and permissions that govern access to the Legal Hold interface. Access can be easily set manually or by group membership within your directory service. The Legal Hold interface allows Legal to manage custodian banks and business itself without having to hire IT to process them or worry about a breach of confidentiality. The presence of previous versions means that the data contained in the default backup is immediately available for discovery, reducing concerns about adverse findings and allegations of looting. To minimize the risk of predatory sanctions, it is recommended that organizations have a company-wide withholding policy that clearly outlines the objectives, steps, and all other aspects of the legal withholding process. Sending a legal retention notice is not sufficient to meet the discovery requirements. The legal department should be aware that each custodian has received, read, understood and accepted the holdback instructions.

This validation is usually done by asking recipients to confirm that they have received and complied with the legal retention obligation. If a depositary does not respond to the blocking notice, the legal service should have a method in place to follow up and escalate communications until the depositary responds positively. When it comes to ensuring that all custodians comply with their custody obligations, consistent oversight is crucial. In addition to regular reminders and requests for regular confirmation of retention commitments, compliance training, where the negative consequences of non-compliance are clearly defined, can be an effective tool to ensure compliance. Through careful monitoring and enterprise-wide compliance, legal suspensions help ensure that all relevant information is retained so that it is available for dispute resolution. Here are some important steps that need to be taken while legal custody is still active: A custodian is the person who personally owns and is responsible for the information that needs to be retained. Before the lock is issued, legal teams typically work with the IT department to identify all custodians relevant to the case. Custodians can also be «silent gatekeepers,» that is, individuals within the organization whose data is retained without notice.

This type of guard is common, for example, in internal investigations. The legal retention notice is the notice sent to all custodians informing them that they are pending and indicating what information should be retained. This is an important part of the legal withholding process, which we will discuss in more detail later. When a user is legally banned, the user experience or comments in the CrashPlan app do not change. From the user`s perspective, there is no difference between the standard backup process and legal locking. In the context of legal stays, your primary goal should be to create an arguable process, which means that your appeal, judge, jury or regulator will deem it appropriate and thorough enough. While perfection is not required, your actions should be appropriate given the information available at the time of action. Legal holds can last for weeks, months, or even years. In general, the Legal Department also sends regular reminders of any legal freeze to the custodian banks concerned. The scope of the statutory retention obligation may also change over time; Updated guidance should outline this revised scope so that custodians know what information needs to be retained.

Since the organization resolves all problems and is no longer subject to a retention obligation, the lock should be lifted (disclosed) so that information that is no longer needed is not retained. This is usually the first step in creating a legal retention period. The legal team must determine what information may be relevant to a case. Today, it is common for this data to be stored electronically (or «ESI»), but it can also include physical documents such as logbooks and paper files. For this reason, it is important that you document the retention notification process to show when and how a legal retention period was issued and confirmed, and whether it was properly maintained from the time of the triggering event. You must keep track of all custodians and actions taken throughout the process – hold, custodian confirmations, maintenance reviews, reminders, and legal authorization. The most effective way to do this is to use legal custody automation software to automatically record all your actions. When ESI is involved (i.e.

99% of the time these days), your IT or legal departments are great allies when it comes to finding information sources and custodians. A robust information governance program is also essential to easily identify where potentially relevant ISIs are located and who is responsible for maintaining them. Once the information to be retained and all custodian banks have been identified, the next step is to create and issue a notice of cessation of litigation. However, if properly developed and implemented, a legal retention policy can significantly improve the organization`s ability to meet its retention obligations. The key is to keep everyone informed of their role in the organization`s compliance obligations to minimize the risks associated with litigation. Any reminder to recipients that the lock and its instructions are still in place and that potentially relevant information should not be changed should also be tracked. Litigation is expensive. Your legal hold software shouldn`t be. A verbal threat of litigation may trigger retention, but only a verbal block notice is not considered «reasonable measures» to actually preserve relevant information.

To be sure, write it down. The legal suspension procedure must begin at the earliest opportunity or when the organization reasonably anticipates litigation. Otherwise, important information could be lost, which could lead to more costly detections or penalties for looting, such as the destruction of relevant evidence. While it is common to think of legal holds as notification sent to trustees to preserve information, the legal hold process actually involves several steps: On the applicant`s side, intentional acts such as sending a cease and desist letter are sufficient to trigger retention obligations. But duty may come sooner. In some cases, the courts have ruled that a plaintiff is obligated, either once they have determined that a claim is appropriate or when they decide to take legal action. Not everyone who reads your embargo period is a lawyer. The purpose of a statutory retention obligation is to ensure that custodians comply with their obligation to retain relevant data.
