Develop and Implement Effective Legal Frameworks

A central role of government is to formulate guidelines by which the government can limit the activities of all stakeholders in sanitation and water management, including itself. Appropriate policies can promote participatory, demand-driven and sustainable development. Policies lead to the development of laws, rules and regulations aimed at achieving policy objectives. A good law for sustainable sanitation and water management recognizes and recognizes existing uses and rights, including international standards. At the same time, it is flexible enough to allow for reforms in response to technological change and socio-economic needs (GWP 2008). First, we provide an overview of existing rights and standards for sanitation and water management. We will then focus on the evolution of the policy process and the legal framework for the implementation of intervention instruments for sanitation and water management. 2.6. Legal acts relating to statistics of international trade in services exist at different levels, including legal acts governing the collection, processing and dissemination of statistics; the working relations of the agencies concerned; and legal acts protecting the confidentiality of information.

The structure of the legal framework may vary from country to country. Often, there is a national statistical law that defines the mandate of the national statistical authority and regulates general statistical issues, such as the establishment of a recall and sanction system for companies that do not comply with the reporting obligation. National legislation could also identify the statistical areas that are part of the mandate. In addition to the general act, additional legal acts could provide for more specific provisions for a single statistical area, such as trade in services or FATS, for the content of the data or the circumstances in which the data are to be communicated to other national agencies. The law could also define valid media and the frequency of reporting and broadcasting. While the day-to-day management of groundwater resources takes place at the national level and often at the local level, national regulatory systems cannot be considered independently of the international legal framework with respect to transboundary aquifers. In such a case, international law determines the rights and obligations of the States with which domestic law is to be made compatible. The legal framework for groundwater management should provide answers to key questions such as who can access groundwater where, for what purposes and under what conditions. How are aquifers protected from depletion and pollution? What criteria should be used to allocate and protect the limited resources of non-rechargeable aquifers? What monitoring and planning tools should be used? How are private and public interests reconciled and how are stakeholders involved in decision-making and management processes? These are some of the questions that this report attempts to answer. (c) it is a prerequisite for the establishment of a high-quality system of official statistics; For example, the first element of the quality assurance framework recommended by the Statistical Commission and the IMF`s Data Quality Assessment Framework for Balance of Payments and International Investment Position (DQAF) Statistics [1] is the availability of a sound legal framework. [2] Creating a legal environment conducive to universal health coverage can be challenging. There is no standard recipe for the UHC laws that a country needs.

There are common approaches, but these need to be adapted to national contexts. In addition, many countries struggle to develop and implement a legal environment conducive to universal health coverage when they have limited legal and regulatory capacity. 2.5. The legal framework promoted by this guide includes legally binding laws and rules governing the relationship between members of the national statistical system and data reporters for data provision, as well as all aspects of data collection and dissemination. A well-established legal framework is the basis for an effective and well-functioning national statistical system for the following reasons: The role of sanitation and water management laws is to implement and enforce policies and provide effective administrative and regulatory mechanisms at appropriate levels. Therefore, the legal framework is an effective and crucial tool to support sanitation and water management at the local level, necessarily accompanied by the formulation or modification of the policy explained above. The creation of modern legislation to support sanitation and water management should result from the development of integrated and coherent local policies. A national government usually has the opportunity to formulate or use policies and/or the legal framework at the national level, which are often binding at a lower political level.

Legislation can be reformed to integrate the fundamental elements of sustainable sanitation and water management and to support the policy objectives of a national, regional or local government. The legal framework should emphasize principles in support of the elements of sanitation and water management. Legal reform issues that contribute to the creation of a sound framework include: Sanitation and water management policies at the local level must be linked to general national economic policies and related national sectoral policies. Sanitation and water management also means that water and sanitation issues must be taken into account in all economic and social sectors. Successful implementation of intervention instruments for sanitation and water management may require changes to existing policies, legal frameworks and institutions – or their further development (see also Creating an Institutional Framework). Identification systems must be based on a foundation of trust and accountability between government agencies, individuals, international organizations and the private sector, both within countries and across borders. A cornerstone of this foundation is the laws, codes, regulations and practices that govern and support the identification system – that is, the «legal framework». The adoption of sound legal frameworks and instruments alone is not sufficient for the enjoyment of rights. What is written on paper has not yet been put into practice so that rights and freedoms have a real and positive impact on the societies, communities and people for whom they exist.

We are therefore investing in the creation and strengthening of open and effective mechanisms and institutions that help ensure that freedom of information, expression and media rights and laws are respected, promoted and respected. (e) contribute to the implementation of an integrated approach to statistics on resident-to-non-resident trade in services and on FATS, since only well-coordinated efforts by several agencies can ensure the successful production and dissemination of such statistics; The stronger the powers of legal coordination at the heart of the statistical system, the greater the chances of effectively integrating statistics; [3] Step 5: Ensure implementation and impact — monitoring and surveillance. Monitoring may be participatory or a public-private partnership may be established for this task. In addition, the local government can be the regulator and oversee the implementation, as well as an NGO. Many water professionals focus on steps 1 and 4 – the formulation of the new policy – without considering the other phases needed to make changes. Important milestones are often ignored as too slow, difficult or unnecessary, especially when a narrowly technocratic or project-based approach is abused in a process of social change. Therefore, always make sure to consider all the steps and some of them don`t rush – formulating/changing policies is a time-consuming process. When modifying or formulating policies that create an enabling environment for sanitation and water management, it is also important that national, regional or local governments adapt their legal frameworks.
